These Terms of Service govern your access to and use of puremdrn.com and any products, features, content, and services made available through the website. The website is operated by PURE MDRN LLC. Throughout these Terms, “PURE MDRN,” “we,” “us,” and “our” refer to PURE MDRN LLC, and “you” and “your” refer to the person accessing the website or purchasing from us.

By visiting the website, creating an account, submitting an order, or otherwise using our services, you agree to these Terms of Service and the policies incorporated into them by reference. These include our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree to these Terms, please do not use the website or place an order.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer our products and services to you.

SECTION 1 - ELIGIBILITY AND LAWFUL USE

You must be at least the age of majority in your state or jurisdiction of residence to make a purchase from us. A parent or legal guardian may permit a minor to browse the website under their supervision.

You may not use the website, our products, or our services for any illegal, fraudulent, or unauthorized purpose. You may not violate any applicable federal, state, local, or international law while using the website.

You must not introduce viruses, malicious code, automated attacks, or other technology intended to disrupt, damage, interfere with, or gain unauthorized access to the website, Shopify, or any related system.

SECTION 2 - WEBSITE INFORMATION

We make reasonable efforts to provide accurate and current information. However, website content may occasionally contain typographical errors, omissions, outdated information, or inaccuracies relating to product descriptions, dimensions, colors, pricing, promotions, availability, shipping charges, processing times, or other matters.

We may correct errors, update information, or modify website content at any time. If an error materially affects an order that you have already placed, we will contact you when reasonably possible and provide any options required by applicable law.

Information provided on the website is for general informational and shopping purposes. It should not be treated as professional, electrical, construction, installation, medical, or safety advice.

SECTION 3 - PRODUCTS AND PRODUCT DESCRIPTIONS

Many PURE MDRN products are produced individually or made to order. Small variations in surface texture, layer patterns, color tone, dimensions, or appearance may occur as a natural result of the materials and manufacturing process. These minor variations do not necessarily constitute defects.

We make reasonable efforts to display product colors and images accurately. Actual colors may vary because of lighting conditions, material batches, screen calibration, photography, and device settings.

Product dimensions are approximate unless expressly stated otherwise. Customers should review the product description, measurements, mounting information, care instructions, and included components before purchasing.

You are responsible for following all installation, charging, use, care, and safety instructions supplied with a product. Mounting hardware and adhesive products must be appropriate for the particular wall material, surface condition, product weight, and intended use. When uncertain, consult a qualified professional.

Cordless accent lights are not intended to serve as primary, emergency, security, or life-safety lighting.

We reserve the right to modify or discontinue products, colors, components, features, packaging, or services. Any material change affecting an existing order will be handled in accordance with applicable law.

SECTION 4 - ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase the products in the order. An automated order confirmation acknowledges that we received your order, but does not guarantee that the order has been accepted or can be fulfilled.

We may reject or cancel an order before shipment when reasonably necessary, including because of product unavailability, an incorrect price or description, suspected fraud, payment problems, shipping restrictions, an inability to fulfill the order, or a violation of these Terms.

We may limit quantities purchased by a person, household, customer account, payment method, billing address, or shipping address. We may also decline orders that appear to be placed for unauthorized resale or other commercial redistribution.

If we cancel an order after payment has been collected, we will issue a refund for the cancelled portion of the order to the original payment method.

SECTION 5 - PRICES, PAYMENT, AND TAXES

Prices are displayed in United States dollars unless otherwise stated. Prices may change without notice, but a price change will not ordinarily affect an accepted order unless the original price resulted from an obvious error.

Applicable taxes, shipping charges, duties, or other charges will be displayed at checkout when required and reasonably capable of calculation.

You agree to provide accurate, current, and complete billing, shipping, contact, and payment information. You authorize us and our payment service providers to charge the payment method provided for the total amount shown at checkout.

We do not directly store complete payment-card information. Payments are processed through Shopify and its supported payment providers, subject to their applicable terms and privacy practices.

SECTION 6 - MADE-TO-ORDER PRODUCTS, CANCELLATIONS, RETURNS, AND REFUNDS

Because many of our products are made or prepared specifically for each order, cancellation may not be possible after production or order preparation has begun.

Return, exchange, cancellation, and refund eligibility is governed by our Refund Policy. Please review that policy before placing an order.

Nothing in these Terms or our Refund Policy limits any consumer right or remedy that cannot legally be excluded. This includes any applicable rights relating to products that are defective, incorrect, materially misdescribed, not delivered, or otherwise subject to a legally required remedy.

When a legally required refund is due, it will ordinarily be issued to the original payment method. Processing time after issuance may depend on the bank, payment provider, or card issuer.

SECTION 7 - PROCESSING, SHIPPING, AND DELIVERY

Processing and shipping estimates are provided in our Shipping Policy and on applicable product or checkout pages. Processing time refers to the time required to prepare an order before carrier pickup and is separate from carrier transit time.

Shipping and delivery dates are estimates unless we expressly identify a date as guaranteed. Carrier delays, weather, holidays, address problems, customs processing, and other circumstances outside our reasonable control may affect delivery.

We are responsible for having a reasonable basis for any shipment timeframe we advertise. If we determine that we cannot ship an order within the timeframe originally promised, we will provide notice and offer the customer the legally required option to consent to a revised shipment date or cancel the unshipped order for a refund.

You are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect or incomplete address, an unclaimed package, or a customer-requested redirection may be the customer’s responsibility to the extent permitted by law.

If tracking shows an order as delivered but it cannot be located, please contact us promptly so that we can review the available tracking and delivery information. Carrier investigations and available remedies depend on the circumstances of the shipment.

SECTION 8 - CUSTOMER ACCOUNTS

Certain website features may allow you to create or use a customer account. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Please notify us promptly if you believe an account has been accessed without authorization. We may suspend or restrict an account when reasonably necessary to protect customers, PURE MDRN, Shopify, or other parties.

SECTION 9 - OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, integrations, applications, payment services, social-media features, or other services operated by third parties. We do not control all aspects of these third-party services.

Your use of a third-party service may be subject to that provider’s own terms, policies, and privacy practices. To the maximum extent permitted by law, we are not responsible for third-party services that we do not own or control.

The website may contain links to third-party websites or platforms. A link does not necessarily mean that we endorse, control, or guarantee the third party or its content.

We are not responsible for the content, security, availability, products, services, or privacy practices of third-party websites. You should review the third party’s terms and policies before providing information or completing a transaction.

SECTION 11 - REVIEWS, PHOTOGRAPHS, FEEDBACK, AND OTHER SUBMISSIONS

You are responsible for content that you submit to us or post through the website, including reviews, photographs, comments, suggestions, and other materials. You must have the necessary rights and permissions to submit that content.

You may not submit content that is unlawful, fraudulent, defamatory, threatening, obscene, misleading, invasive of privacy, infringing, or harmful to another person or entity.

When you submit content for public display through our website, tag PURE MDRN in public social-media content, or expressly authorize us to use submitted content, you grant PURE MDRN a nonexclusive, worldwide, royalty-free license to reproduce, display, format, and share that content in connection with our website, social media, advertising, and business communications.

This license does not transfer ownership of your content to us. You may contact us to request that we stop using content in future materials, although we may not be able to recall materials that were already printed, published, distributed, or lawfully used.

We may moderate, reject, or remove submitted content when reasonably necessary, but we are not obligated to monitor every submission.

Unless otherwise stated, the website and its content are owned by or licensed to PURE MDRN LLC. This includes product designs, photographs, illustrations, graphics, logos, trademarks, written content, videos, page layouts, and other materials.

You may use the website for personal, noncommercial shopping purposes. You may not reproduce, copy, modify, distribute, publish, sell, reverse engineer, commercially exploit, or create derivative works from our website content or product designs without our prior written permission, except where such restriction is prohibited by law.

PURE MDRN and related names, logos, product names, and branding may be trademarks or other protected identifiers of PURE MDRN LLC. No right to use them is granted except as expressly stated.

SECTION 14 - PROHIBITED USES

You may not use the website or its content:

For an unlawful, fraudulent, or deceptive purpose;
To violate another person’s intellectual-property, privacy, publicity, or other legal rights;
To harass, threaten, abuse, defame, or unlawfully discriminate against another person;
To submit false or misleading information;
To transmit viruses, malware, or destructive code;
To collect personal information about others without authorization;
To send spam, phishing messages, or other unauthorized solicitations;

To the maximum extent permitted by law, PURE MDRN LLC and its owners, employees, contractors, service providers, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, services, or products, including lost profits, lost revenue, lost data, or loss of business opportunity.

To the maximum extent permitted by law, our aggregate liability for a claim arising from a product purchase will not exceed the amount you paid to PURE MDRN for the product giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any responsibility that cannot legally be excluded or limited. Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

SECTION 17 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless PURE MDRN LLC and its owners, employees, contractors, and service providers from third-party claims, damages, liabilities, and reasonable legal expenses arising directly from:

Your unlawful or unauthorized use of the website;
Your material breach of these Terms;
Content you submit that violates another party’s rights; or
Your intentional misuse or unauthorized modification of a product.

This section does not require you to indemnify us for our own negligence, willful misconduct, or violation of law.

SECTION 18 - EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delays or failures caused by events outside our reasonable control, including severe weather, natural disasters, power or internet outages, labor disruptions, carrier interruptions, governmental actions, supply-chain interruptions, or failures of third-party platforms.

This section does not eliminate any obligation to provide legally required shipment-delay notices, cancellation rights, refunds, or other non-waivable consumer remedies.

SECTION 19 - TERMINATION

These Terms remain effective while you use the website or services. You may stop using the website at any time.

We may suspend or terminate access to the website when we reasonably believe that you have materially violated these Terms, engaged in fraudulent or unlawful activity, threatened the security of the website, or harmed another user.

Termination does not affect rights, obligations, payment responsibilities, or liabilities that arose before termination. Provisions that by their nature should survive termination will remain effective.

SECTION 20 - SEVERABILITY AND WAIVER

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed to the minimum extent necessary. The remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce that provision or another provision later.

These Terms, together with the policies and notices incorporated by reference, constitute the entire agreement between you and PURE MDRN concerning your use of the website and purchase of products through the website.

They supersede prior or contemporaneous communications concerning the same subject, except for any separate written agreement signed by an authorized representative of PURE MDRN LLC.

SECTION 22 - GOVERNING LAW AND DISPUTES

These Terms and any dispute arising from them, the website, or a purchase from PURE MDRN are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Subject to any consumer rights or jurisdictional protections that cannot legally be waived, legal proceedings relating to these Terms or a purchase from PURE MDRN shall be brought in a state or federal court with jurisdiction in Harris County, Texas. You and PURE MDRN consent to the personal jurisdiction of those courts.

Nothing in this section prevents you from exercising a right to bring a claim in another location when applicable law does not permit that right to be waived.

SECTION 23 - CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our products, services, practices, or legal obligations. The revised version will be posted on this page with an updated revision date.

Changes will apply prospectively from the date they are posted unless applicable law requires otherwise. The Terms in effect when you placed an order will generally govern that order.
